Help in applying for the EU Settlement Scheme

Wales is home to thousands of EU citizens who enrich our communities and contribute to our public services and economic success immeasurably. They are our friends, our neighbour, our work colleagues and our family members. The impact here in Wales, in our community and our workplaces of EU citizens leaving the UK could be quite significant, and so we need to increase awareness of citizens’ rights and support them to remain here.

EU citizens and their families who have been continuously resident in the UK for five years until the end of 31 December 2020 may apply for settled status through the UK Government’s EU Settlement Scheme. They will continue to be able to work, study, and access benefits and services in the UK on the same basis as they do now. Those who have not been continuously resident for under five years will be eligible for pre-settled status. They will also be able to work, study and access benefits and services on the same basis as now.

In July, the Welsh Government announced a package of free legal advice and support to help EU citizens prepare for Brexit and continue to live and work in Wales.

This package of support:

  • Offers support with applications and give advice on social welfare issues and workplace rights through the network of Citizens Advice throughout Wales;
  • Provides a free immigration advice service offering specialist support for complex cases, delivered by immigration legal specialists, Newfields Law;
  • Increases the provision of digital support centres in Wales – to help those without the digital means to apply for settled status;
  • Works with a range of charities and partners across Wales to raise awareness of the need to apply for settled status in hard-to-reach and vulnerable communities.

Mae Cymru yn gartref i filoedd o ddinasyddion yr Undeb Ewropeaidd sy’n cyfoethogi ein cymunedau ac yn gwneud cyfraniad amhrisiadwy i’n gwasanaethau cyhoeddus a’n llwyddiant economaidd. Maen nhw’n ffrindiau i ni, yn gymdogion, yn gydweithwyr neu’n aelodau o’n teulu. Gallai gweld dinasyddion yr UE yn gadael y DU gael effaith sylweddol ar ein cymunedau a’n gweithleoedd yma yng Nghymru, ac felly mae angen inni godi ymwybyddiaeth am hawliau dinasyddion er mwyn eu cefnogi i aros yma.

Gall dinasyddion yr UE a’u teuluoedd sydd wedi bod yn preswylio’n barhaus yn y DU am bum mlynedd tan 31 Rhagfyr 2020 wneud cais am statws preswylydd sefydlog drwy Gynllun Preswylio’n Sefydlog i Ddinasyddion yr UE, Llywodraeth y DU. Byddant yn parhau i allu gweithio, astudio a chael buddion a gwasanaethau yn y DU ar yr un sail ag yn awr. Bydd y rhai nad ydynt wedi bod yn preswylio’n barhaus am bum mlynedd yn gymwys am statws preswylydd cyn-sefydlog. Byddant hefyd yn gallu gweithio, astudio a chael buddion a gwasanaethau yn y DU ar yr un sail ag yn awr.

Ym mis Gorffennaf, cyhoeddodd Llywodraeth Cymru becyn o gymorth a chefnogaeth cyfreithiol am ddim i helpu dinasyddion yr UE i baratoi ar gyfer Brexit a pharhau i fyw a gweithio yng Nghymru.

Mae’r pecyn cymorth hwn yn:

  • cynnig cymorth gyda cheisiadau ac yn rhoi cyngor ar faterion lles cymdeithasol a hawliau yn y gweithle drwy rwydwaith Cyngor ar Bopeth ledled Cymru;
  • darparu gwasanaeth cynghori ar fewnfudo am ddim sy’n cynnig cymorth arbenigol ar gyfer achosion cymhleth, drwy gwmni cyfreithiol sy’n arbenigwyr ar fewnfudo, Newfields Law;
  • cynyddu’r ddarpariaeth o ganolfannau cymorth digidol yng Nghymru – i helpu’r rhai heb fynediad at dechnoleg ddigidol i wneud cais am statws preswylydd sefydlog;
  • gweithio gydag amrywiol elusennau a phartneriaid ar draws Cymru i godi ymwybyddiaeth o’r angen i wneud cais am statws preswylydd sefydlog mewn cymunedau agored i niwed ac anodd cyrraedd atynt.
