Ymgynghoriad Llywodraeth Cymru: Cymru Fwy Cyfartal – Cychwyn y Ddyletswydd Economaidd-gymdeithasol

Heddiw mae Llywodraeth Cymru yn lansio ymgynghoriad wyth wythnos – Cymru Fwy Cyfartal – Cychwyn y Ddyletswydd Economaidd-gymdeithasol.

Daw’r ymgynghoriad i ben ar 17 Ionawr 2020 – byddem yn croesawu eich safbwyntiau.

Y Cefndir:

Blaenoriaeth i Lywodraeth Cymru yw gweithredu i ddiogelu cydraddoldeb a hawliau dynol, yn enwedig yng nghyd-destun Brexit. Un rhan o’r gwaith hwn yw cychwyn y ddyletswydd economaidd-gymdeithasol – ymrwymiad o faniffesto etholiad Prif Weinidog Cymru.

Mae hyn yn golygu rhoi Rhan 1, Adran 1 o Ddeddf Cydraddoldeb 2010 ar waith – y ddyletswydd economaidd-gymdeithasol. Mae’n ei gwneud yn ofynnol i gyrff cyhoeddus penodol, wrth wneud penderfyniadau strategol fel ‘penderfynu ar flaenoriaethau a phennu amcanion’, ystyried sut y gallai eu penderfyniadau helpu i leihau anghydraddoldebau sy’n gysylltiedig ag anfantais economaidd-gymdeithasol.

Cynigir y bydd y ddyletswydd yn berthnasol i’r cyrff cyhoeddus cymwys canlynol, gan y tybir eu bod wedi bodloni’r ‘prawf’ o dan adran 2(6) o Ddeddf Cydraddoldeb 2010:

ü  Gweinidogion Cymru

ü  Byrddau Iechyd Lleol

ü  Ymddiriedolaethau’r GIG

ü  Awdurdodau Iechyd Arbennig Cymru

ü  Awdurdodau Lleol

ü  Y Gwasanaethau Tân ac Achub

ü  Awdurdod Cyllid Cymru

ü  Awdurdodau Parciau Cenedlaethol.

Bydd yr ymgynghoriad yn casglu safbwyntiau aelodau’r cyhoedd a rhanddeiliaid allweddol ynghylch pa gyrff cyhoeddus y mae’r ddyletswydd yn berthnasol iddynt a sut mae’r ddyletswydd yn cael ei gweithredu.

Bydd yr ymatebion i’r ymgynghoriad yn llywio canllawiau i sicrhau bod y ddyletswydd economaidd-gymdeithasol yn gweithio ar gyfer y cyrff cyhoeddus y mae’n berthnasol iddynt ac yn cyflawni ar gyfer pobl Cymru.


Welsh Government consultation: A More Equal Wales – Commencing the Socio-economic Duty

Welsh Government today launches an eight week consultation – A More Equal Wales – Commencing the Socio-economic Duty.

The consultation closes on the 17 January 2020 – we would welcome your views.

Background:

A priority for the Welsh Government is to take action to safeguard equality and human rights, particularly in the context of Brexit. One piece of this work is through commencing the socio-economic duty – a commitment from the First Minister’s election manifesto.

This involves enacting Part 1, Section 1 of the Equality Act 2010 – the socio-economic duty. It will requires specified public bodies, when making strategic decisions such as ‘deciding priorities and setting objectives’, to consider how their decisions might help to reduce the inequalities associated with socio-economic disadvantage.

It is proposed that the duty will apply to the following eligible public bodies, as they are deemed to have satisfied the (‘test’ under section 2(6) of the Equality Act 2010:

ü  Welsh Ministers;

ü  Local Health Boards;

ü  NHS Trusts;

ü  Welsh Special Health Authorities (HEIW);

ü  Local Authorities;

ü  Fire and Rescue Services;

ü  Welsh Revenue Authority; and

ü  National Park Authorities.

The consultation seeks the views from members of the public and key stakeholders on which public bodies should be captured by the duty and how the duty is implemented.

The responses to the consultation will inform guidance to ensure the socio-economic duty works for public bodies to whom it applies and delivers for the people of Wales.
